Former Kebs director testifies in Kosgey case

Kenya Bureau of Standards (Kebs) earned revenue from vehicles exempted for the eight-year old rule, a court has been told.
Former Acting Kebs Managing Director Mutisya Kioko informed an Anti-Corruption Court that he would not know if former Industrialisation Minister, Henry Kosgey benefited from the exemptions.
Kioko was giving evidence in an abuse of office case against Kosgey. The Tinderet MP is alleged to have allowed three companies and three individuals to import 113 vehicles that were more than eight years old.
He told Nairobi Principal Magistrate, Elijah Obaga that individuals who applied for their motor vehicles to be exempted from the eight-year-old rule were required to pay Sh15,000 for their vehicles to be inspected.
Revenue for kebs
"Kebs earned some revenue. If an applicant does not pay Sh15,000 (to Kebs) the vehicle would not be inspected," Kioko said.
On the other hand, if any of the vehicles were found to be unroadworthy, they would not be cleared.
He said there were complaints about the number of vehicles being exempted, but there was no enough justification.
The vehicles were being exempted from requirements of the Kenya Standard KS: 1515:2000
Those exempted were left hand drive vehicles and those over eight years old.
The KS: 1515:2000 is a local standard on inspection of motor vehicles imported.
It stipulates what Kebs should look at when it in vehicle importation.
On Tuesday, the witness said Industrialisation PS, Engineer Karanja Kibicho wrote to him on July 21, last year, directing the letters pass through his office before any waivers were granted because they were suspecting fraud and Kenya Anti-Corruption Commission was investigating the issue.
Kioko said all the exemptions were before July 21, 2010.
He also said while he served as the secretary of the National Standards Council, he did not formulate guidelines or policies that the minister would use to grant waivers,

That money is my capital for the business and right now im stranded. If you just sold that unit tell me to choose another vehicle from your stock list or you refund me the total amount at once. If you want loans, get from the banks not swindling customers. you are destroying the name of your company.

You should be joking. I cannot go into any contract with you for a refund. Where have you taken my money? You are a big company and cannot fail to source for $15950. It has taken four months now since you got my money and remember that the value is going down against the dollar.
 
That lawyer is a fool because me i have not agreed. I also have a lawyer who has advised me to just follow it up with interpol. Let me tell you that if i come there to japan you will have to refund me for air tickets and hotel accomodation.
 
By the way, why have you removed the vehicle that i ordered from your stock list? Im giving you upto Friday to refund me. please give me my money if you want peace. I will continue to destroy the name of your company, you will never have business in zambia and other neighbouring countries.

I have been negotiating with my banker to solve the situation for a long time but they eventually told me that it is not possible for them to lend the fund in the present situation.

They have told me that they are contacting the Zambian High commissioner to japan in Tokyo to help with this situation. They have also advised me that i need to contact a lawyer and what you should know is that all charges for the lawyer will be paid by you. you should also realise that remitance charges by the bank has also to be refunded.
 
You have placed a wrong button and you will regret what you have done. if JICA will sponsor an air ticket for me to come there, im coming. You have started a war and it will only finish when you refund me. I HAVE GIVEN YOU FIVE DAYS IN WHICH YOU SHOULD REFUND ME. I should also tell you that INTERPOL is already informed about your scam.

RESISTA Inc. A JAPANESE CAR DEALER SWINDLING HUGE SUMS OF MONEY FROM UNSUSPECTING CUSTOMERS.
Many unsuspecting Zambians have been swindled huge sums of money by a Japanese car dealer called Rezista inc. Sources have indicated that this scam has been reported even in other countries like Zimbabwe and Kenya. Mr. Kingsley Chisenga of Kitwe has been swindled of $15950 which he wired to this company for the purchase of a Landcruiser prado in March this year. He has since reported this scam to Interpol who has to contact the Japan state police for the possible arrest of these swindlers. This company has been collecting money from customers but has not been shipping the vehicles. The director for this company is Mr. Ryota Kamijo & the sales representatives are Mr. Ohori and Mr. Arakawa. People looking for vehicles are therefore advised not to do business with this company.
