Former Kebs director testifies in Kosgey case

Published on 08/06/2011
By Judy Ogutu
Kenya Bureau of Standards (Kebs) earned revenue from vehicles exempted for the eight-year old rule, a court has been told.
Former Acting Kebs Managing Director Mutisya Kioko informed an Anti-Corruption Court that he would not know if former Industrialisation Minister, Henry Kosgey benefited from the exemptions.
Kioko was giving evidence in an abuse of office case against Kosgey. The Tinderet MP is alleged to have allowed three companies and three individuals to import 113 vehicles that were more than eight years old.
He told Nairobi Principal Magistrate, Elijah Obaga that individuals who applied for their motor vehicles to be exempted from the eight-year-old rule were required to pay Sh15,000 for their vehicles to be inspected.
Revenue for kebs
"Kebs earned some revenue. If an applicant does not pay Sh15,000 (to Kebs) the vehicle would not be inspected," Kioko said.
On the other hand, if any of the vehicles were found to be unroadworthy, they would not be cleared.
He said there were complaints about the number of vehicles being exempted, but there was no enough justification.
The vehicles were being exempted from requirements of the Kenya Standard KS: 1515:2000
Those exempted were left hand drive vehicles and those over eight years old.
The KS: 1515:2000 is a local standard on inspection of motor vehicles imported.
It stipulates what Kebs should look at when it in vehicle importation.
On Tuesday, the witness said Industrialisation PS, Engineer Karanja Kibicho wrote to him on July 21, last year, directing the letters pass through his office before any waivers were granted because they were suspecting fraud and Kenya Anti-Corruption Commission was investigating the issue.
Kioko said all the exemptions were before July 21, 2010.
He also said while he served as the secretary of the National Standards Council, he did not formulate guidelines or policies that the minister would use to grant waivers,

Dear Mr Ryota Kamijo,
Mr Kamijo, why are you complicating this whole thing? If you can't refund me please ship the vehicle. I can't understand why your financial difficulties have affected the shipping of the vehicle that i ordered. My lawyer has advised the following:
  1. why have you removed the vehicle i ordered from the stock list? What has your financial situation got to do with removing it? you just sold to another person.
  2. The pictures on the stock list are fake, the vehicle never existed or you have just sold that vehicle to another person.
  3. cyber thefts are an international issue and are criminal in nature and me the complainant, im not japanese and so we cannot apply japanese law but international criminal law.
  4. your financil situation came gradual not sudden, you could have told me not to send the money. So your intention was to swindle me of the money.
  5. You are getting money from customers by false pretence you supply vehicles then use it to do business and promise to refund them after you have made profit using their money which is criminal.
  6. You are still in the business of selling vehicles, if you just sold that vehicle, why can't you ship another vehicle from your stock?
To tell you the true you have done me alot of torture mentally. I can't sleep and i cannot eat. Im depressed. That alot of money you are holding on to. I feed my family from doing business, i pay for my house, i pay for my children's school from the same business. Please feel pity for me. That money is my capital for the business and right now im stranded. If you just sold that unit tell me to choose another vehicle from your stock list or you refund me the total amount at once. If you want loans, get from the banks not swindling customers. you are destroying the name of your company.

Please reply soon.

Dear Mr,Kingsley.

Thank you very much for your reply.

I sincerely apologize for your inconvenience caused.

Though we have been exporting the vehicles for over six years, the cause of we are now in the position of not been able to export your vehicle is aggravation of fund management. Therefore we propose to enter into the contract of refund and fulfill our duty to continue the business operations.

Concerning your information that you may plan to come to Japan, I advise you to discuss with your lawyer very well in advance about below facts before you make the concrete plan. I am so afraid we will not be able to pay for the cost for you to come over to Japan considering the financial situation of the company.

1. The cause of REZISTA not being able to ship the vehicle upto now is aggravation of fund management.
2. We have been exporting vehicles for over six years and has its all records in the company.
3. Such being the two issues above, we don’t have any aggravated purpose so as it is not going to be the criminal case but the civil case in the law of Japan.
4. In case the judgement may lead the company to bankrupt, I will not able to fulfill the duty to complete the refund.

In line with this I would like to fulfill the duty to enter into the contract of refund.
I am so afraid if it will not fulfill your demand but I will appreciate for your consideration and would like to have your reply.

Dear Mr Ryota Kamijo,

You should be joking. I cannot go into any contract with you for a refund. Where have you taken my money? You are a big company and cannot fail to source for $15950. It has taken four months now since you got my money and remember that the value is going down against the dollar.

That lawyer is a fool because me i have not agreed. I also have a lawyer who has advised me to just follow it up with interpol. Let me tell you that if i come there to japan you will have to refund me for air tickets and hotel accomodation.

By the way, why have you removed the vehicle that i ordered from your stock list? Im giving you upto Friday to refund me. please give me my money if you want peace. I will continue to destroy the name of your company, you will never have business in zambia and other neighbouring countries.

Reply just now.

Dear Mr,Kingsley.

I sincerely apologize for your inconvenience caused.

I have been negotiating with my banker to solve the situation for a long time but they eventually told me that it is not possible for them to lend the fund in the present situation.
It is really unfortunate that though we have quite many clients in Zambia and have trust by exporting the vehicles for over six years, we are now in the position of not been able to export your vehicle cause of  the aggravation of fund management.

After long consultation with our lawyers, we propose to enter into the contract of refund and fulfill our duty to continue the business operations.
We also reported our circumstances to the embassies and related authorities in Japan.
In line with this I would like to fulfill the duty to enter into the contract of refund.
I will not go anywhere and be opened to you.

I am so afraid if it will not fulfill your demand but I will appreciate for your consideration and would like to have your reply.

The message from the Victim who lost their money by the Fraudster in Tradecarview

RESISTA Inc. A JAPANESE CAR DEALER SWINDLING HUGE SUMS OF MONEY FROM UNSUSPECTING CUSTOMERS.
Many unsuspecting Zambians have been swindled huge sums of money by a Japanese car dealer called Rezista inc. Sources have indicated that this scam has been reported even in other countries like Zimbabwe and Kenya. Mr. Kingsley Chisenga of Kitwe has been swindled of $15950 which he wired to this company for the purchase of a Landcruiser prado in March this year. He has since reported this scam to Interpol who has to contact the Japan state police for the possible arrest of these swindlers. This company has been collecting money from customers but has not been shipping the vehicles. The director for this company is Mr. Ryota Kamijo & the sales representatives are Mr. Ohori and Mr. Arakawa. People looking for vehicles are therefore advised not to do business with this company.

My BMW is still at the port now awaiting to be sold on the next Auction. All this had been caused by your deliberate action of shipping the unit without JAAI. I have already paid you, FULL CIF Amount in USD since early February 2008.

October Last year (2008) you said that I pay for the Non Inspection Fee (penalty) here in my country and you promised to refund the money which is 30% of CIF price. You never refunded me though you REQUSSTED FOR MY BANK ACCOUNT.
Storage charges have reached almost 3 Millions Tanzanian Shillings.

Message from the person who had lost his money by the Fraudster in Tradecarview

Real Voice from the person who lost his hard earned money by the Fraud in Tradecarview.

Good morning,
My name is Nzwalo Sikaluzwe living in Zambia. I have been your customer since 2000 and I have bought over 10 vehicles for my self and friends. Infact Mr Izawa used to be my sales contact. I read this article on fraud with interest. Two months ago I was looking for Harrier for my wife. She wanted a black one. I checked your site and you didnt have on your site. A friend of mine introduced me to Tradecarview website in Japan where he had bought  his Harrier. I was registered as a member.  So I checked through the stock advertised. I made inquiries for a number of them until I made up my mind to get it from MA Trade. I checked that the company was listed in Tradecarview dealers list and I visited the site. They were even given a rating of premium exporter by Tradecarview. They even had a location map and physical address. They basically hosted by Tradecarview web site. I proceeded with negotitionns and finally transferred money ($6500) to MA Trade on 18th January 2010. We were initially communicating through the Tradecarview mail system until Mr Maekawa suggested I give my email so he could send me an invoice. He confirmed that he received the money. He later communicated that the vehicle would be shipped on the 30th. When I tried to reply to his mail, I discovered that my mails could not reach him. I went to Tradecarview website to send a mail using my account, I got a message that I couldnt contact the dealer as the service for the dealer has been stopped and I was given the number on which to contact them. I tried the number and it was ringing and no one answered it. I tried to check the Dealer in Tradecarview dealers' list, I discovered they had been removed. I searched for the company using google and fortunately I found the company details still appearing on the Tradecarview web ( I have attached the web). Some information that was there was missing. I contacted Tradecarview by telephone and I was told to fill up a complaint form. They say they will follow up the issue. However   they are trying to disassociate themselves from the whole issue despite them connecting me to the dealer. I checked their site if MA Trade is in the list of their blacklisted companies, they are not there. To me the removal of this company from their dealers list despite giving them a premium certification without alerting me as their member and especially that I was in touch with them through their site is dishonest conduct by Tradecarview. I didnt know this dealer myself. I was connected to him through them. To me it means the risk of fraud is very high on this site. If they host dealers they are not sure of, let them not rate them. I read through their site how they grade them. Initially they ask the companies advertising on their site to submit company profile and registration forms verified by an independent third party. They even clearly state to their sellers that if they give them premium rating they buyers have more confidence.

Kindly help me Trace this man. Tradecarview gave me his drivers licence and contract copies. I have attached this documents. I have also attached the invoice, TT copy and my communication on Tradecarview website.

Im still looking for a car for my wife. She still wants a Harrier, but now Iam shot of money. I might buy a Nadia.

Please help me recover my money.

Regards

Nzwalo Sikaluzwe

Message from the person who had lost his money by the Fraudster in Tradecarview

This is the original message from the person in Zambia.

Dear Sir/Madam,

I recently bought a car from TRADITION  Japan, a used car japanese dealer on Tradecarview on 24/02/2011.  Two days after payment, the dealer was removed from the website.  The dealer TRADITION Japan, whose contact person/owner is Ebi Masanori confirmed receipt of the money on 01/03/2011.  Since then he has not answered any emails or calls and his phone and fax numbers are out of order now.  Kindly assist me with the contact details of Chamber of Commerce Japan and JUMVEA so that I can lodge a complaint as per your article dated 07/12/2009 titled BE CAREFUL ABOUT INTERNET FRAUD OF USED CARS EXPORTER.  I will also appreciate if I can have email address of SUMITOMO MITSUI BANKING CORPORATION- NAKAMOZU BRANCH, SAKAI CITY.

Attached are copies of my payments for the car to TRADITION.

Regards,

Simbeye Raphael Zambia

Car Export Scam Unveiled

The Aichi Prefectural Police and its International Investigation Department in Nagoya city, has arrested Mr. Inoue (age 32), and three others, on suspicion of fraud for false advertising of automobile sales via overseas websites. Others arrested were Yoshihisa Yamatani, Company Executive (47), Hidetoshi Yamashita, self employed (37) and Keiko Miyazaki, part timer (36).
It is alleged that in early October 2009, they conspired to advertise the sale of used cars on a website in English without actually owning the vehicles, nor the intention of purchasing such vehicles. A 40 year old male civil servant from Uganda was tricked into transferring the sum of 330,000 Japanese Yen into their bank account.
The four people posted a website under the name of Dream Stock Trade (DST) via the website portal Tradecarview in August, 2009. Over a 2 month period up to October, they displayed over 240 vehicles as DST stock, despite not owning more than 10 vehicles under their own name, and with no export trade experience. There were 70 complaints from 17 countries as a result of deals made through the DST website over non-receipt of vehicles delivered, totaling about 22,000,000 Japanese Yen.
Furthermore, the prefecture police believe these four people arrested are involved with another two companies using the same portal website, other than DST, which have received over 40 complaints totaling 20,000,000 Japanese yen.
The above article was posted in the Chunichi Newspaper in Japan on May 19th, 2011. The original article appeared in Japanese as follows:

Also, I had found another Website about Tradecarview......

http://www.sitejabber.com/reviews/www.tradecarview.com

I had never used Tradecarview, because many people say there are a lot of Fraudster and Scam in their Website......   but, once I browse through the Internet.....  there are thousands of story about the Fraudster and Scams of Tradecarview Website.....
Even Tradecarview itself.... they are confirming that there are Fraud and Scam in their Website,  therefore Tradecarview is announced to stop dealing with these companies of Tradecarview directly.........   But, they are Premium Member, right ???   They are Premium member,  but Tradecarview is announcing to stop dealing with these Premium member directly..... which is which ???
Tradecarview is recomended these Premium members.... but, Tradecarview announced to stop dealing with them directly.....

It seems that Tradecarview can not control their Website anymore........

Today's News paper in Japan....   we had found Bad News about Tradecarview once again.......

I love TOYOTA LANDCRUISER !!!

These nice pictures were supplied by Star Auto, Ltd.    Thanks Star Auto, Ltd.

I'm checking the Car informations,  I will keep updating good informations, like this.   I hope this Blogs make people to smart to choose right vehicle and right company.

I have found one interesting News from one of the Blogs.

The following is the message whihc I had found one of the Blogs in the net and I also had seen this News on the News paper in Japan.

One of the Fraudster in Trade Car View was caught by Japanese Police

According to the Latest News, one of the Fraudster in Trade Car View was caught by Japanese police, because of fraud that the company in Trade Car View showed their FAKE stocks on the Trade Car View Website and got the money, but they never send the vehicle.
They got more than US$ 275,000 from the people in the World, Africa, Caribbean countries, Oceania, Europe, etc, etc....

http://www.chunichi.co.jp/s/article/2011051990021009.html

Actually, the Fraudster was a Premium member of Trade Car View who had advertised their fake stocks on Trade Car View Website for long time.   But, I think the Trade Car View itself had known about that company very well and Trade Car View had known about the fraud, also.   See the following URL.   This is the Black list member in Trade Car View, but ALL of them were Premium Member of Trade Car View.
 http://www.tradecarview.com/help/blacklist/

Actually, we were the one of the member of Trade Car View,  but there were so many frauds in Trade Car View,  so we stopped dealing with them.   We know how to be a Member of Trade Car View, if we want to be a Member of Trade Car View,  we can just contact them,  then they will come to our office,  then pay the member cost,  then we can be a member of Trade Car View.    This means that the staff of Trade Car View had met to the peoplel who is fraudster when they becoming a member of Trade Car View.

But, even they had know the fraud,  but they don't stop them....    is this the business ???

One of the fraudster was caught by the Japanese police,  but  this is just one of the many fraudster in Trade Car View....  which means there are still a lot of Fraudster in Trade Car View who is adverting their fake stocks on Trade Car View.....

When you buy the vehicle,  Please be carefull.

Please choose the right vehicle from the right company.
